Falling Balcony Glass Leads to Class-action Trial

Ontario’s Superior Court certified three class-action lawsuits for trial against the developers, builders and subcontractors of three Toronto condominiums after glass panes fell from the balconies starting in 2010, according to an Oct. 10 Toronto Star report.At least a dozen glass panes from the three buildings fell on the streets of Toronto, and a woman’s wrist was reportedly slashed after glass shattered on a city street, according to the report. “The city shut down the balconies on those buildings and ordered [repairs], and so all the people living in those units were locked out of their balconies for almost two years,” Ted Charney, one of the lawyers for the plaintiffs, told the Star.Charney said the lawsuits will now go to trial, and the rulings will apply to all building residents. He also said the judge's decision was significant, because it marks the first time a developer will potentially be held liable for breach of contract because of their marketing practices, The Star reports.
