Three New Jersey Glass Businesses Facing Charges of Illegal Practices

The state of New Jersey recently filed action against three glass businesses for illegal practices.

On July 24, the state’s Division of Consumer Affairs filed a nine-count civil complaint against J&L Glass & Construction Corp., Its All Glass Corp. and Glass Dynamix Corp., alleging the companies incorrectly installed replacement shower doors and glass, supplied damaged merchandise and accepted payment for work they failed to perform, among other things.

Close to three dozen consumers filed complaints with the state against the defendants, prompting the investigation, which was conducted by Jared O’Cone. The complaint, filed in State Superior Court in Hackensack, also names Joel R. Tobia and Evelyn Perez as defendants.

Tobia and Perez are the principals of J&L and Dynamix Corp., and Tobia also controls Its All Glass.

The state alleges Tobia and Perez violated the Home Improvement Contractors’ Registration Act and related regulations, as well as the Delivery of Household Furniture and Furnishings regulations.

According to court documents, the defendants’ contracts listed business locations where the companies didn’t maintain offices. The state also maintains the contracts were deficient in that they didn’t include a notice to consumers about their right to cancel the contract and failed to include delivery dates.

“We’re determined to hold these businesses accountable for their allegedly illegal business practices,” Division of Consumer Affairs action director Steve Lee said in a press release. “Consumers should get the home improvements and fixtures that they paid for, not suffer additional costs for damages caused by home improvement companies themselves.”

According to the release, the state is seeking to “dissolve the companies’ corporate charters, bar Tobia and Perez from owning or operating another home improvement contracting company and reimburse affected customers,” among other things. The complaint states the defendants have been in business since at least February 2008.
